Farm consists of 100 acres +/- with 45 acres +/- currently workable. The balance being woodlot, yard and some unworked land. Property also features a farm home, detached garage and 2 implement sheds.  Farm land has an irrigation pond and has never had ginseng grown on it.

TERMS: Down payment of $50,000.00 by cheque day of auction with balance due within 45 days. Property selling subject to executor’s approval to settle the estate.

CONDITIONS OF SALE  

  1. The property is described as 701 2nd Concession Rd. STR, Delhi Ontario, MID CON2 STR PT LOT 23 REG, located in the Norfolk County, Roll # 541-060-04800-0000 shall be sold as is, where is, subject to minimal reserve bid.
  1. The highest bidder shall be the purchaser. In any case of dispute between bidders, the property shall be immediately put up for auction again.  No person shall retract his/her bid.
  2. The purchaser, at the time of sale, shall pay a deposit of $50,000.00 dollars of the amount of the purchase money, and the sale shall be completed within 45 days when the balance of said purchase money shall be paid unless previous arrangements have been made. HST where applicable will be charged.
  3. Advertised acreages of 100 +/- acres and workable acreage of 45 +/- is an approximate acreage and is not grounds for dispute.  There are no guarantees or warranties with respect to water, septic or soil.
  4. Immediately after the sale the purchaser shall sign a contract to complete the sale according to these conditions.
  5. All adjustments of insurance, rents, local improvement rates and other assessments to be apportioned to the date of completion of sale, when possession shall be given.
  6. The purchaser shall not be entitled to abstract or other evidence of title not in the possession of the vendor, and shall make any objections to the title in writing to the Vendor Solicitor within 15 days from the date of auction, and in default of making any such objections the purchaser shall be deemed to have accepted the title.
  7. If any objection shall be made which the vendor shall be unable or unwilling to remove, the vendor shall be at liberty to rescind the sale, and in such case the purchaser shall receive back the amount paid, without interest, in full satisfaction of all claims.
  8. If the purchaser fails to comply with the conditions aforesaid or any of them, the deposit and all other payments made thereon shall be forfeited, and the property may be re-sold, and the deficiency, if any on such re-sale, together with all charges attending the re-sale, shall be made good by the defaulter.
  9. Time shall be of the essence of these conditions.
